1. Definitions:
1.1. Accommodation.
1.2. Accommodation provider:
The provider of the reserved accommodation is also responsible for the provision of services such as key delivery, maintenance, etc. in situ and also receives the correspondent payment (depending on the reservation).
1.3. Booking agents:
The landlord himself, a possible intermediary or another independent organization is responsible for the administrative processing of the reservation and will receive the payments.
1.4. Tenant:
The person mentioned in the reservation form.
1.5. Rental price.
1.6. Reservation.
1.7. Reservation form.
1.8. Tenant:
Person (owner) or company that represents the owner who provides the mentioned property in the reservation form.
2. Scope:
These general conditions of reservation are applicable to all booking contracts between the Tenant and Landlord.
3. Conclusion of the reservation contract:
When the tenant makes a reservation through the Internet, in writing, by telephone, by e-mail or personally with the owner or with another booking agent, a contract will be celebrated to which the present general conditions apply.
4. Modifications:
Modifications to the reservation contract and exceptions to these general booking conditions will only take effect if they have been agreed in writing between the owner or booking agent and the tenant.
5. Payment conditions
When booking, the agreed advanced payment, usually 30% of the rental amount, must be in the possession of the booking agent 3 working days after the reservation is made, only then is the reservation considered valid.
· The 30% payment can be made either by bank transfer, or by credit or debit card.
· The second payment corresponds to 70% and will be paid 40 days before arrival.
· In case of reservations made with less than 40 days in advance, 100% will be paid after booking the house.
6. Price:
Prices are indicated in euros per accommodation and also per week or per day.
7. Cancellation:
The contract will be rescinded (the reservation will be cancelled) if the tenant does not comply with the disposed in point 5.
8. Annulment:
At the moment in which this booking contract is formalized, cancellation fees will apply; any cancellation must be made in writing.The date of its reception will determine the cancellation expenses according to the following criteria:
· 50% of the rent, when 41 or more days before entering to the property.
· 100% of the rent, in case it takes place 40 - 0 days before entering the property.
In the case that the client leaves the accommodation voluntarily, for any reason or circumstance before the end of the contract, the company is exempted from any type of refund for this concept.
9. Insurance:
The rental price does not include insurance, unless it is expressly stated that the rental price includes insurance and the type of insurance it is. The booking agent can inform you about the possibility of hiring an insurance.
10. Landlord’s responsibility:
The accommodation provider, the booking agent or the landlord will not be liable in any way for the loss (of value) and / or damage of the tenant's and other occupants' belongings caused by the incorrect use of the leased property. If the tenant suffers damages as a result of defects in the leased property, the responsibility of the landlord will be limited to the rental price. The legal compensation will be applied to the damages that have occurred as a consequence of the contractual breach of the landlord. The landlord will not be responsible for any other damage.
11. Tenant’s responsibility:
The tenant who reserves accommodation for other occupants (besides himself) will be liable for the total rental price and the damages caused by his conduct and for the conduct of all others who remain with him in the rented accommodation. The reservation will be valid for the number of people indicated in the reservation form. If the tenant intends to accommodate more than the permitted guests in the rented accommodation, the tenant must request it in writing to the reservation agent prior to the beginning of the rental period. The accommodation provider may refuse to do so or may charge an additional fee.
12. Documentation:
The client must be identified by a formal identity document that contains a photograph, signature, national identification number and expiration date.
13. Modification or rescission:
The Landlord may modify or cancel one or some of the essential points of the agreed services due to serious circumstances. Serious circumstances are those that are of such a nature that it is not considered reasonable to demand compliance of the contract with the provider of the accommodation.
In case of force majeure, war, strikes and natural disasters, the accommodation provider may cancel the reservation. In this case, the booking agent is obliged to return the amounts already paid.
14. Complaints:
If you notice any deficiencies in the accomodation, you are expected to notify the landlord or the local booking agency / agent, in order to avoid inconveniences. When serious complaints arise in situ, you should immediately inform the accommodation provider. In this way, the hosting provider has the opportunity to solve your complaint as soon as possible.
15. Cleaning service costs:
Cleaning costs: € 70 / booking.
16. Linens and towels:
Bed linen and towels are included in the rental amount.
17. Pets:
Pets are allowed.
18. Choice of jurisdiction and applicable law:
Unlike the legal norms on the competence of the civil judge, any dispute between the supplier and the contracting party or the client will be submitted exclusively to the competent judge of the country or region where the Landlord is established or is a resident.
